⚖️ Romanian citizenship through court: what to do if ANC has not reviewed your case for over 2 years
In 2025–2026, thousands of applicants for Romanian citizenship ran into the same problem:
📂 The DOSAR has been filed with ANC ⏳ 2, 3, and sometimes even 4 years have passed ❌ No order ❌ No decision ❌ Inquiries get standard replies with nothing specific
Many keep simply waiting, considering it a “normal delay.” But from a legal point of view, the situation looks different.
📌 Romanian Law 14/2025 sets a specific time limit for reviewing a case: — 2 years from the registration of the DOSAR — plus a possible extension of at most 6 months
That is, the maximum review period is 2.5 years.
If this time limit is breached, it is no longer a queue. It is a violation of the applicant’s right to have the case reviewed within the time limit set by law.
And it is at this point that a lawful tool of protection becomes available — the administrative court of Romania.
What does going to court give you?
✅ The Tribunal București can order ANC to review your case ✅ After the court’s ruling, ANC usually issues a decision within 30–90 days ✅ Instead of waiting 4–5 years, the process takes about 6–12 months
In practice, it looks like this:
- an official inquiry about the status of the case is sent to ANC
- the breach of the time limit is confirmed
- the legal position and the claim are prepared
- the case is filed with the Tribunal București
- lawyers represent the applicant in court
- after the ruling, ANC’s compliance with it is monitored
In most cases the client does not need to be present in Romania. The process is conducted remotely under a power of attorney.
📊 According to court practice, more than 70% of such claims are granted, because a breach of the review time limit is an obvious legal fact.
It is also important to understand something else:
⚠️ Even if ANC files a recurs (an appeal), this does not mean the case is lost. It is a standard procedural stage for which you need to be legally prepared.
At Alliance we provide systematic support in such proceedings: — we analyze the grounds for going to court — we prepare the claim and the evidence base — we represent the client’s interests at the Tribunal București — we handle the recurs if necessary — we monitor the enforcement of the court’s ruling — we coordinate the further stages until the ANC order is issued
For many applicants, the administrative court becomes the only real way to complete a citizenship process that has stood still for years.
