Residence permit in Romania after temporary protection: which ground to build and how long it takes

You can switch from temporary protection to your own residence permit in Romania at any time: there is no need to wait for protection to end, nor to give it up while you prepare.
There is one limitation, and it sets the calendar: a residence permit requires a personal ground — work, business, family or study — and a ground is not built in a month.
Temporary protection has been extended until March 4, 2028, by EU Council Decision 2026/1912 in force since August 5, 2026.

What happens to the ground when temporary protection ends?

Nothing — if the ground is personal. Protection ends by a decision made without you; your own residence permit ends only if you yourself do not renew it.

The difference between the two statuses is fundamental. Temporary protection is a collective mechanism: it is switched on and extended by a decision at EU level, and you cannot influence that decision. A residence permit is a personal status on your own ground: you renew it as long as the ground is met, and it does not depend on general decisions on protection.

There is also a second reason not to wait. Years under temporary protection do not count toward the residence period required for permanent residence: the count starts with your own residence permit. Every month on a personal status works for the future; months of waiting simply pass.

Who can make the switch, and which grounds work in Romania?

The switch is available to anyone who has a personal ground or is ready to build one.
Workable grounds — 4: an employment contract with a Romanian employer, your own business, family reunification and study.

Salaried work suits cases where the employer is ready to handle the paperwork and keep the contract stable: the status is tied to the employer. The family ground works when one of the spouses already holds their own status.
Study is the route for those enrolling at a Romanian university.

For most families, the workable structure is their own company: an SRL with real activity, an account, accounting and an employment contract with your own company. Such a structure does not depend on other people's decisions and brings status, income and assets together. You do not need to move: the city you live in, the children's school, the doctor and your work stay the same.

Which documents are gathered in advance, while protection is in force?

The basic file is the same for all grounds: a passport, proof of residential address, health insurance and proof of means. The fourth block is the documents of the ground itself, and it is this block that decides the outcome of the case.

For work, these are the employment contract and the employer's documents. For business — the SRL's registration documents, an account at a Romanian bank, active accounting and an employment contract with your own company. For family — certificates of marriage or kinship with translation and legalization. For study — proof of enrollment.

While protection is in force, time works for you, and this is when the things that later become expensive and slow are done: recovering documents from archives, translations and legalization, checking the chain of kinship where surnames are spelled differently, checking the employer, launching accounting in your own company.
The list for a specific case is fixed before filing — this rules out returned files and repeat visits.

How does the switch work: procedure, timelines and cost?

The plan has 5 steps: assessment and choice of ground, building the ground, assembling the file, filing, and the decision with the residence card.

First — assessment and choice of ground: the ground is chosen to fit your situation, income, family and plans, not the other way round.

Second — building the ground: for business, this means registering an SRL, opening an account, launching accounting and an employment contract; for work, processing the documents with the employer.

Third — assembling the file: translations and legalization, insurance, proof of address and means.

Fourth — filing with the General Inspectorate for Immigration at your place of residence.

Fifth — the decision and the permis de ședere, from which your personal residence period begins.

Preparation takes from a few weeks to 2–3 months depending on the ground; in practice, a submitted file is reviewed in about 30 days, and the period is extended if additional documents are requested. The calendar is set not by the filing date but by the absence of reasons to return the file.

The cost, per the live service page, is as follows: setting up a company from 1,300 euros, with documents prepared by a lawyer and a registered address, about a month, remotely; status support 1,300 euros, about three months, one trip for biometrics; accounting 600 euros a year; the full cycle about 4 months. What if you have put it off until the last moment?

Start now — by recording where you stand and choosing a ground. Lost months do not close the path, but each further month of waiting costs a month of residence period.

The plan "I'll deal with it closer to the end of protection" runs into 2 circumstances. First: a ground is not built in a month.
An SRL becomes a ground not on the day of registration, but when it has an account, accounting and an employment contract.
Second: as the general deadlines approach, the inspectorate's workload grows, and filing in a calm period goes faster and more predictably.

The order of action is simple. Record what you already have in hand. Choose a ground you can keep for years, not just until the first filing. Build it in parallel with protection: protection stays in place, and you lose nothing.

A separate case is when a file has already been submitted and was returned.
A return is a normal working situation: the cause is removed, the documents are put in order, and the filing is repeated.
The only thing worse than a return is a pause after it.

Do I need to give up temporary protection to apply for a residence permit?

No. Protection remains in force while the ground and the file are being prepared. The switch happens at the moment your own status is issued, with no break in legal stay.

Will my wife and children be able to switch too?

The ground for the family arises through reunification: when one of the spouses holds their own status, documents are processed for the others. The composition of the family file is fixed during the assessment.

Do I need to move to another city?

No. The structure is put together where you already live: the city, the children's school, the doctor and work do not change.
